San Francisco Bay Area

Palo Alto, CA

One of the most competitive single-family markets in the country: most houses sell over asking, and buyers are expected to study the seller-provided inspections before they offer. What a lot can become is set by layered local rules (single-story overlays, Individual Review for second stories, protected trees, flood zones) sitting on top of generous state housing laws.

💡 Upside tip

Before you price in a second story or a rebuild, pull the city Parcel Report: an "(S)" suffix on the zoning means a single-story overlay (about 17 ft, one floor), and any new second story or second-floor expansion over 150 sq ft needs discretionary Individual Review. Then search Permit View by APN and compare the permit history with the disclosure package.

Offers & competition

Listings typically go live midweek with a suggested offer date about a week later; sellers may still accept a pre-emptive offer before then. Non-contingent offers and seller-provided pre-inspections are the norm, and a buyer's own pre-offer inspection runs about $500 to $800. In June 2026, 25 houses sold over list price versus 9 under.

Closing & who pays

Escrow and title companies close the deal; no attorney is required. By Santa Clara County custom the seller pays the escrow fee, the owner's title policy and the county transfer tax.

Transfer taxes

County tax is $1.10 per $1,000 and the city adds $3.30 per $1,000, for 0.44% in total (about $15,400 on a $3.5M home). The city portion is customarily split between buyer and seller, so confirm the split in the purchase agreement.

Seller disclosures

California requires the TDS, the Natural Hazard Disclosure (NHD) and any Mello-Roos or PACE assessment notice, and the agent's visual inspection is documented on the AVID; the SPQ is added by contract. Here the full package, usually with inspection and pest reports, is released before the offer date.

What you can build

R-1 floor area is 0.45 FAR on the first 5,000 sq ft of lot plus 0.30 above that (6,000 sq ft cap), with a 30 ft height limit; Single-Story Overlay (R-1(S)) areas cap homes at one floor and about 17 ft (20 ft in flood zones). State law adds an ADU plus a JADU, or SB 9 duplexes and lot splits, and since July 1, 2026 SB 79 upzones land near all three Caltrain stations (University Ave, California Ave, San Antonio) at its top tier.

Permits & records

Any new two-story home, new second story, or second-story expansion over 150 sq ft goes through Individual Review, a discretionary Director decision; Eichler tracts also follow the voluntary 2018 Eichler Design Guidelines, which reviewers reference. Permit history is searchable by APN on Permit View (launched December 2025) and in Accela Citizen Access, but original 1950s and 1960s plans usually require a records request.

Property tax

Under Prop 13 the assessed value resets to the purchase price and then rises at most 2% a year; the first-year bill runs roughly 1.1% to 1.2% of price, and a separate supplemental bill follows the sale. Add the PAUSD school parcel tax of about $905 a year.

Rent rules

State law AB 1482 caps most rent increases at 5% plus regional CPI (10% maximum) with just-cause eviction rules, but single-family homes and condos are generally exempt under Costa-Hawkins. If the house was tenant-occupied in the past 3 years, SB 9 is not available for it.

Key risks

Much of the city east of Middlefield Road lies in FEMA flood zone AE, and the San Francisquito Creek overflow area is zone AH, so lenders require flood insurance there (Palo Alto is a CRS Class 6 community, which earns discounts). Trees 15 in. in diameter or larger (11.5 in. for native oaks, 18 in. for redwoods) are protected and need a removal permit. Eichlers carry big-ticket items such as in-slab radiant heat (about $26K to $35K to replace) and flat or foam roofs.

⚠ Still verifying

R-1 numbers come from code aggregators, not the official municipal code. Single-Story Overlay petition thresholds are reported inconsistently, and the city has no published list of overlay districts. No official Individual Review or plan-check timelines are published. The PAUSD parcel tax renewal (Measure B) failed in June 2026, so the expiry of the current tax is unclear. Palo Alto's SB 79 alternative plans and the city's lack of local rent caps need confirming. No source pins the market rhythm to a specific weekday.
